Shell disagrees with the court opinion refusing to invalidate the decision of the antimonopoly committee of Ukraine in its investigation on Shell

On 21st March 2017 the first instance court announced its decision regarding the legal claim of Alliance Holding”, LLC against the Antimonopoly Committee of Ukraine (the “AMCU”). Alliance Holding”, LLC, which is Shell entity operating its retail fuel network in Ukraine, is seeking to invalidate the AMCU decision announced on 29th October 2016 that has penalized the company at almost UAH 40 mln of fine for alleged anticompetitive concerted actions on parallel pricing in fuel retail market.
Shell acknowledges that the court in its decision upheld the fine imposed on the company, although completely disagrees with this decision. Shell position is standing firm: no infringement of Ukrainian competition law has been committed by the company; fuel price changes were each time driven by purely economically based approach, in view of the existing fuel supply offer and other market factors.
Shell will review the court decision in detail and determine the avenues how to further defend itself.
